These Terms of Service (“Terms” ) govern your access to and use of https://winsdiscount.com and your purchase of products from WinsDiscount (“WinsDiscount,” “we,” “us,” or “our” ). By using the Services or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, and our Refund Policy.

1. Store and Eligibility

WinsDiscount operates an online retail store offering fashion products. You must be at least the age of majority in your jurisdiction to purchase products or use an account, unless a parent or legal guardian permits use as allowed by law.
You agree to provide accurate, current, and complete information when using the Services, including your name, email address, mobile telephone number, billing information, and shipping information.

2. Products, Images, and Availability

We make reasonable efforts to describe and display products accurately. Colors may appear differently depending on your device and screen. Product descriptions, images, sizes, materials, prices, and availability may change.
All products are subject to availability. We may correct errors, limit quantities, discontinue products, or cancel an order when necessary because of an inventory, pricing, technical, payment, fraud, or other legitimate issue. If we cancel an order after receiving payment, we will process the applicable refund according to our Refund Policy and the payment provider’s procedures.

3. Orders, Prices, and Payment

Placing an order is an offer to purchase. An order is accepted when we send an order confirmation or otherwise confirm acceptance. We may decline or cancel an order where permitted by law.
You authorize us and our payment providers to charge the payment method selected at checkout for the order total, shipping, taxes, and other charges shown before purchase. Prices, promotions, and availability may change. The price charged is the price displayed at the time the order is placed, subject to correction of an obvious error.

4. Shipping and Returns

Shipping is governed by our Shipping Policy. Returns, exchanges, and refunds are governed by our Refund Policy. Those policies form part of these Terms.
Estimated delivery times are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, or events outside our reasonable control, subject to any mandatory consumer rights.

5. SMS Marketing Terms

5.1 Program description

If you separately opt in to WinsDiscount SMS marketing, you agree to receive recurring automated marketing text messages from or on behalf of WinsDiscount at the mobile telephone number you provide. Messages may include product announcements, new arrivals, promotions, discounts, cart reminders, and other commercial messages.

5.2 Consent

By checking an SMS marketing consent box, submitting a qualifying SMS sign-up form, or using another clear affirmative opt-in method, you consent to receive SMS marketing messages from WinsDiscount. Your consent is not required as a condition of purchasing products or using the Services.
Consent to receive email marketing does not constitute consent to receive SMS marketing. Consent is not valid if the SMS option is preselected or if the number was purchased, scraped, or imported without valid permission.

5.3 Frequency and rates

Message frequency varies. Message and data rates may apply. The number of messages depends on your interaction with the Services, your selected preferences, campaigns, promotions, and operational needs. Mobile carriers are not responsible for delayed or undelivered messages.

5.4 How to opt out

You can stop receiving SMS marketing messages at any time by replying STOP to a marketing message. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT where supported. After you send an opt-out request, you may receive one final confirmation message. After that, no further SMS marketing messages will be sent unless you provide new consent.

5.5 Help and customer support

For help, reply HELP to a marketing message or email info@winsdiscount.com. You may also contact us about a wrong number, a privacy request, or an SMS consent question using the same email address.

5.6 Transactional messages

Opting out of marketing SMS does not necessarily stop non-marketing messages that are necessary to provide a service you requested, such as order confirmation, delivery, return, account-security, or fraud-prevention messages. You may have separate controls for those communications.

5.7 No transfer of consent

Your SMS consent is for WinsDiscount and may not be transferred or sold to unrelated third parties. We may use Shopify, Shopify Messaging, SMS service providers, messaging networks, and wireless carriers to deliver our messages and maintain opt-out records.

5.8 Changes or termination

We may change, suspend, or terminate the SMS program at any time. If the program is terminated, we will honor applicable opt-out requests and will not use a terminated program to send new marketing messages.

7. Third-Party Services

The Services may use third-party services for hosting, payments, shipping, analytics, customer support, email, SMS, and social media. Your use of a third-party service may be subject to that provider’s terms and privacy policy. We are not responsible for the independent policies or availability of third-party services, except as required by law.

To the maximum extent permitted by law, WinsDiscount is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Services, delays outside our reasonable control, or third-party services. This limitation does not apply where prohibited by law.

10. Governing Law

These Terms are governed by the law that legally applies to WinsDiscount and the relevant transaction, without removing mandatory consumer-protection rights. Do not insert a specific state or court unless it accurately reflects the company’s legal connection and has been reviewed for your business.

11. Changes to These Terms

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the Services after an update constitutes acceptance only to the extent allowed by applicable law.
